1. About RiskAI X

RiskAI X is a property risk intelligence platform operated by Diamond Properties Investments SRL, a Romanian legal entity (CUI 50535310), registered in Romania, European Union. We provide AI-powered analysis of seismic risk, cadastral data, flood risk, heritage status, and related property intelligence across multiple European and Middle Eastern markets.

2. Acceptance of Terms

By accessing or using riskaix.com, riskaix.com/app, or any RiskAI X API (collectively, "the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

These terms apply to all users including individuals, real estate professionals, financial institutions, and API clients.

3. Nature of the Service — Important Disclaimer

Specifically:

• Seismic risk scores are derived from official government databases (AMCCRS, INFP, USGS, NOA) and do not replace professional structural assessment
• Cadastral data reflects information from ANCPI, Ktimatologio, and other registries at the time of query — it may not reflect the latest status
• Flood risk data is derived from Copernicus, JRC, and open-meteo data — it does not replace an official flood risk assessment
• Heritage status data is sourced from LMI and equivalent national registries — verify directly with the relevant Ministry of Culture
• AI-generated investment analysis is illustrative only and does not constitute financial advice

4. Subscription Plans and Payments

RiskAI X offers both free and paid subscription tiers. Paid subscriptions are processed through Paddle (our payment processor). By subscribing, you agree to Paddle's terms of service.

• Billing: Subscriptions are billed monthly or annually as selected at checkout
• Cancellation: You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period
• Refunds: Refunds are handled in accordance with Paddle's refund policy. We offer a 7-day refund for first-time subscribers who have not exceeded their plan's API call limits
• Price changes: We reserve the right to change subscription prices with 30 days notice
• Free tier: The free Explorer tier is provided as-is and may be modified or discontinued at any time

5. Acceptable Use

You may use the Service for lawful purposes only. You may not:

• Systematically scrape or bulk-download data beyond your plan's API limits
• Resell or redistribute RiskAI X data or reports without a white-label or reseller agreement
• Attempt to reverse-engineer our risk scoring algorithms or data sources
• Use the Service to make or publish misleading claims about properties
• Attempt to circumvent rate limits, authentication, or access controls
• Use the Service for any purpose that violates applicable law, including EU data protection regulations

6. API Access

API access is available on Gold, Diamond, Platinum, and Palladium plans. API usage is subject to rate limits as specified in your plan. Exceeding limits will result in temporary throttling. We reserve the right to suspend API access for abuse or misuse.

API clients must not expose their API keys publicly. You are responsible for all usage under your API key.

7. Data Sources and Accuracy

RiskAI X aggregates data from official government and open-data sources including but not limited to: ANCPI (Romania), AMCCRS (Romania), INFP (Romania), Ktimatologio (Greece), USGS, EMSC, Copernicus (EU), JRC (EU), OpenStreetMap, and Wikidata.

We make reasonable efforts to ensure data accuracy but cannot guarantee that all information is current, complete, or error-free. Government data sources may have delays, gaps, or inaccuracies. We do not warrant the accuracy, completeness, or fitness for any particular purpose of any data provided.

8. Intellectual Property

The RiskAI X platform, scoring algorithms, user interface, branding, and proprietary datasets are the exclusive property of Diamond Properties Investments SRL. All rights reserved.

You may not copy, reproduce, distribute, or create derivative works from our platform without explicit written permission. Individual property reports generated for your use may be shared in the normal course of your professional activities.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Diamond Properties Investments SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Decisions made in reliance on our property risk scores or reports
• Financial losses from property transactions
• Inaccuracies in underlying government data sources
• Service interruptions or data unavailability

Our total liability to you for any claim shall not exceed the amount paid by you for the Service in the 3 months preceding the claim.

10. Service Availability

We aim for high availability but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, upgrades, or emergency security patches. We will endeavour to provide advance notice where possible.

11. Privacy and GDPR

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms. As a EU-registered entity processing personal data of EU residents, we comply with the General Data Protection Regulation (GDPR). You have the right to access, correct, and delete your personal data — see our Privacy Policy for details.

12. Changes to Terms

We may update these Terms from time to time. We will notify subscribers of material changes by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of Romania and the European Union. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Romania, without prejudice to your rights as an EU consumer.
